By accessing or using AiVizWiz (“the Service”), operated by Simone Leonelli / W230, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

AiVizWiz is an AI-powered creative studio for generating, editing, enhancing, rotating, and animating images and video. The Service uses third-party AI models and APIs to produce content based on your prompts.

• Access is granted via Google OAuth or a shared passphrase at our discretion.
• You are responsible for maintaining the confidentiality of your credentials.
• We reserve the right to suspend or terminate access at any time, for any reason, without prior notice.

• Certain features consume credits. Credits can be purchased through the Service via Stripe.
• All purchases are final and non-refundable unless required by applicable law.
• Credit balances have no cash value and cannot be transferred or redeemed for cash.
• We reserve the right to modify credit pricing and consumption rates at any time.

You agree not to use the Service to:

• Generate illegal, harmful, defamatory, or obscene content.
• Infringe on intellectual property or privacy rights of others.
• Generate deepfakes or non-consensual imagery of real people.
• Attempt to reverse-engineer, exploit, or attack the Service.
• Use automated tools to scrape or overload the Service.
• Circumvent access controls, rate limits, or security measures.

Violation of these rules may result in immediate termination without refund.

• You retain ownership of the prompts and original images you provide.
• Ownership of AI-generated outputs is subject to the terms of the underlying model providers (fal.ai and their model licensors). We make no proprietary claims over your outputs.
• The AiVizWiz brand, UI design, and codebase remain the property of W230 / Simone Leonelli.

To the fullest extent permitted by law, W230 / Simone Leonelli shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or AUD $50, whichever is greater.

You agree to indemnify and hold harmless W230 / Simone Leonelli from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your content, or your violation of these terms.

We do not guarantee uninterrupted or error-free operation. The Service may be modified, suspended, or discontinued at any time without notice. We are not liable for any downtime or data loss.

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

We may revise these Terms at any time. Continued use of the Service after changes constitutes acceptance. We encourage you to check this page periodically.
